Other Than Honorable VA Benefits

To be considered a “veteran” eligible for Department of Veterans Affairs (VA) Health Care benefits, a former service-member must have been discharged “under conditions other than dishonorable.” Under VA regulations, administrative discharges characterized by the armed services as “Honorable” or “General Under Honorable Conditions” are qualifying, and punitive discharges (“Dishonorable” or “Bad Conduct”) issued by general courts-martial are disqualifying.

You can get healthcare for service connected disability with a OTH discharge-BUT--you will have to pay a Co-pay and you will NOT get Compensation and will on a lowest level for being seen at the VA hospital also if you have secondary condition or conditions because of you service connected disability the VA will NOT cover them. If you made a mistake and found yourself with a OTH discharge you carry that for LIFE--unlike illegal aliens who will ghet a free pass and get better jobs than you--don't ya luv our system.

  2. I am a Vet who received an OTH discharge in the mid-80's after about 8 years of service. I had some not-to-serious medical issues after about 2 years of service. In 2008 my medical issues got worse and I applied for VA compensation and benefits. I had to write a narrative explaining why I believed I deserved the benefits. After a lot of appointments and paperwork, my benefits and compensation were granted. I'm now rated at 30% and I currently recieve a monthly compensation check. This all happend with an OTH. It can be done.

    1. Where do I write to get more va benefits? Especially dental. My mouth is bad and getting worse. I am in pain everyday. I can't afford to get it fixed on my own.

    2. Thank You that is encouraging because I received an OTH for smoking Marijuana in the 80's and I fell on the ship and seen a shipmate of mine jump overboard and I haven't yet received my compensation but my advocate is appeal this decision because it is from Dec 2003 threw 2013.

  3. My husband went to the VA for 6 years with a OTH discharge. His psychiatrist rated him at 75%, we than moved to another state and now the VA will not even see him. He cannot get any benefits not even medical. He is had PTSD, diabetes, hypertension and the things that you receive from agent orange that wasn't suppose to make people sick. I wish you could tell me how. Thanks

    2. my son received an oth and he doesnt like to talk about it but I think it was infedelity. He married very young and the girl was very hard to live with. No excuse but he was unfaithful which lead to many other situations. I hurt for my son, and wish something could be done to reverse this oth. He is not sickly but does have diverticulitis and with this lovely government we have, healthcare is so expensive. No insurance and now as he ages, this may need more attention. What can he do to get va healthcare, if at all. I cant call anyone, then it would be like "mommy has to do it for her son." And thats not what I want to do. It wouldnt help him anyways. I guess he just doesnt want anymore bad news. Help someone please.

  4. Okay, this is what you need to do... You have to be kind of demanding... If one VA hospital was willing to rate him at a 75% rate, AND if you have that documented, you SHOULD be able to get proper medical benefits from the local VA.

    Have you provided information to you local VA about his phychiatrist rating him at 75 percent?

  6. With a Other than Honorable discharge in leiu court martial you will NOT get Rated for Service connected Disabilities. You will get told if your eligable for Medical care for your condition BUT you will have to Pay Co-Pays and get treated like chit.

  7. The above is not correct. It will depend on when your injury was sustained and whether that period of service was considered honorable. The period in which I sustained my injury is also the period in which I reenlisted and was given an honorable discharge. If, for example, during your first enlistment you were injured and then given an OTH you may not be given VA benefits.

  10. Someone Shed some light on this please. I was in the army, served in Iraq for 9 months in 2003, came home on leave and tried to take my life via prescription med, sent to emergency room, stabalized, transfered to va, unit came picked me up and braught me back to post, charged with desrtion for attempting suicide, took a chapter 10 in lue of court martial. why am I not able to get benifits when I believe combat caused the issue to begin with. And I never deserted by the way

  11. I attempted suicide after I came home from iraq, and got charged, and i took a chapter 10 in lue of cm. shouldnt i be able to get benefits. Its was a combat related illness. This was 7 years ago.

  12. In the late 1980's i recieved an OTH in leu of court martial. For reason's of being AWOL. I had a drug addiction in which i tried to tell them when i finally turned myself in to provost martial. the options I was given was to go to my next duty station and recieve my punishment or get out on an OTH discharge. I already tried to get my discharge upgraded, but it was denied.Do anyone have any advise?

  13. im being discharged with an OTH..I have 30 days leave...am I allowed to use them before I check out, or can the CORPS keep them without compensation ie.selling the days back.?

    1. You must use them before you check out because they will not give you the money for them with a OTH.

  14. If a person has 2 honorable discharges and one OTH discharge on 3rd enlistment, will you still be eligible for the post 9/11 GI bill because my first 2 enlistments were honorable?

  15. That is entirely up to your command if they grant you the leave you can take it, but if your being admin separated then you cannot sell back your leave...so take it, thats what i did!

    2. Hi I need some help. Had 4 year enlistment, involuntary extended and in 8 months got a OTH.
      Can I still use my honorable time for federal jobs, medical, ect.
      Were can I find this in a reg or CFR.

  19. i got OTH discharge with service connected dissablity. i get all the health care benefits including emergency dental care. i dont get paid for my service connected dissability but i get SSI.

    1. And you are put at the end of the line--waiting also have to pay a Co-Pay,,Only the service connected disability is Covered--NOTHING ELSE,,,so if they treat you for other things be prepared to be found out in the future and they will come for thier$$$$$

  20. Question: I've been in the Navy for 9years. I'm on my 3rd enlistment. I'm facing a possible OTH discharge. Can I use the GI Bill based on those two prior enlistments? They were both for more than 36months and both were honorable discharges. How does that work?

  21. Can a CO reccommend involuntary discharge (OTH), using offenses from a prior enlistment, but for the same reason (Article 86)?
    Got an article 86 in my 02-06 enlistment, but I'm now on my 09 - pres enlistment.

  22. I am an Iraq Vet, served in 2003 during the invasion. Needless to say I suffered from Severe PTSD, and with this it cost me my career. I was charged for going UA(unauthorized absence) and trying to commit suicide. I was thrown in the brig for 2 months and discharged with a Bad Conduct Discharge. It took me 6 years, but I got all VA benefits back, am compensated for injuries, got back paid, bought a house with my VA Home Loan and am currently going through Voc Rehab at the VA so I can go back to school for 4 years...all paid by the VA. For those of you answering with "it cant happen", "you'll never get benefits back" etc, your right and wrong! It all depends on your service, injuries, charges and the way in which you were discharged(general court martial, special court martial, admin separation etc).   23. i got a oth in 77, i got into a fight and my cc give me CCF, and i was married at the time, he also
    refused to give me my paycheck but show it too me and laugh.., so i couldnt pay our rent.so
    my wife was living in our car, so i had to leave
    there, i went AWOL...stayed gone for 2 yrs hoping there was a new cc fuk;em
    and i would have die for my country until i found out how one man could mess up your live..

I had an oth in 07. i failed for marijuana and went ua. i served for 3 1/2 yrs. i went irag and was diagnosed with ptsd. can i still get the farm house loan that was a benefit still able to be recieved for services from the fu<kin marine corp!!! i remember the briefing before i got kicked out and that was the only benefit i could recieve basically and i was wondering if anyone knew anything about it. oorah! mutha fu<kers!!!

  26. I am in guard right in Serving in Kuwait, I have done tours in Iraq from 03-05 then back from 05-07, just did a tour in Qatar from 09-10 now in Kuwait till next march.
    I have honorable discharges from all my other deployments but I don't want to be here anymore and I have gotten my self into some trouble. Now there tryin to take my rank and make me an E1 for saying what was on my mind. I would rather take an OTH then loose my rank. It does not mean much bc in the guard no matter how hard you work and no matter what do you. If you move from state to another you can't pick up rank so from 02-till now I am still an E4 and that sucks and I am just sick of it.
    I love the Infantry and everything but its all bull to me now.

  27. Just another quick piece of advice. If you have a less than honorable discharge you can go to a local Veteran Service Officer for help! If you are a combat veteran with a less than honorable you can use your local Vet Center free for therapy, marital therapy etc.

  28. As long as you receive one honorable discharge you are good to go. In other words if you re enlisted and have had one honorable discharge then you are eligible for ll of your benefits to include the GI Bill. I have had 2 honorable discharges and my last was an OTH. My benefits are 100% good and the only people that get screwed are the first time enlistees.

How do you get them because I received an OTH on my 2nd enlistment for just drinking incidents, no drugs or anything and I went to the VA hospital in San Diego the other day and the girl just looks at my DD214 and says I forfeited all my benefits. All I was trying to do was see if I could get some help for my back problems that stemmed from the military. I haven't asked the VA for help in almost 4 yrs since I been discharged.

    2. You can still get Va benefit if you had a honorable discharge your first enlistment. Take your first dd214. I was just approve . Good Luck

  30. I am a fellow OTH discharge guy. i made mistakes in my career in the military; i didnt think about the consequences in getting busted with smoking Spice the gas station drug. I was a BM3 in the Navy living in Yokosuka, Japan. i really regret my actions in my past yet i was curious about FASFA and getting into college to start over. i cant dread on the past i want to move on with my life and do better. My question is there any chance that the FASFA can help me get into college.

    1. Yea you can get FAFSA with an OTH. Just don't get drug related charges on the outside bc that disqualifies you.

I was in the army 1977, I rent home on leave, I took additional 30 days (awol) turned myself in and requested that I be returned to my unit in germany, and was told that because I awol'd from overseas I would have to choose a stateside base to be restationed at, or I could accept a discharge under other than honable conditions, I took the easy way out and have lived with that shaim for 33+ years, And have regreted it ever since, my questions are:
    1. How differcult is it to change under other than honable, into a general discharge?
    2.And with my current dicharge status "under other than honable" Are there ANY benefits that I am entitled to? you can also email me at:

  32. I was separated with an oth for popping hot for thc. I know I messed up and I failed my unit. However, I've wanted to serve since I was young and wound up doing stuff that was not legal. I went to a board hearing to be separated. I am currently in college and trying to pay my way through. My question is, is there any way I can return to the service? I was army national guard because of a GED and scored a 96 on my asvab...

  34. I divorced my ex husband almost a year ago who was discharged from the Navy with an OTH for UA. He passed away in July. We have two children that I am now raising alone. Are there any benefits for my children out there? Thank you for ANY help at all. livingood2011@hotmail.com

    1. Your ex. should have already had benefits for them if he signed your kids up! Did he have benefits himself? If he didn't the kids wouldn't either. Most vets don't know that they can get benefits for OTH. Lawyers don't even know that! Fight for what you can get, it's going to be hard but just don't give up! All you can do is try!

  35. I received an OTH in 2002 for adultery after 15 years of service (E7). Does an OTH prevent me from obtaining a SECRET security clearance? I have held a TOP SECRET during my career. I had an oth discharge I came home on a 30 day leave my mother was dying from cancer I put in for a humantarian transfer to the states to be closer to her, while waiting on a anwser for the transfer I was granted 15 day extra leave, my request for transfer was denied so i filed an appeal on the transfer ask for a few more days extention but was denied . my mother had no one there to look after her so i stayed 15 days extra til i got someone there to look after her and then came back to my command in italy where i was court marshall and given an oth discharge . can that be over turned also its been 20 yrs. anybody have a anwser please email me at darrylguy212hotmail.com

  37. I received an OTH under chapter 14-12c, commission of a serious offense. No excuses, I did wrong. I served 6 years in the Army Reserve, 2 years in the National Guard and 19 years with 8 months in active service. No combat service but a lot of humanitarian deployments.
